Terms of Use

1) Acceptance of Terms

By accessing or using Alliya (the “Service”), you agree to these Terms of Use (“Terms”). If you do not agree, do not use the Service.

2) Service Description

Alliya lets users submit a website URL to run automated accessibility checks and receive a score and findings. The Service may use third-party tools and APIs (e.g., Google Lighthouse / PageSpeed Insights or similar) to generate results.

3) No WCAG Certification / No Compliance Guarantee

The Service does not provide a formal WCAG certification and does not guarantee compliance with WCAG (A/AA/AAA) or any accessibility law or regulation.

Any “WCAG-aligned” or “WCAG-mapped” information is provided for guidance only and reflects automated checks that cover only a subset of accessibility requirements. Many accessibility requirements require human review and contextual judgment.

4) “As Is” and “As Available” Disclaimer

The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.

Results may vary over time and may include false positives/false negatives due to limitations in automated testing, network conditions, third-party services, or changes in the target website.

5) User Responsibilities

You agree that:

  • You are responsible for verifying any recommendations before implementing changes.
  • You will use the Service for legitimate purposes and in compliance with applicable laws.
  • You will not rely on the Service as the sole basis for legal, regulatory, or compliance decisions.

6) Acceptable Use

You agree not to:

  • Use the Service to attack, disrupt, overload, or impair any website, system, or network (including through denial-of-service).
  • Use automated scripts or bots to generate excessive requests or bypass rate limits.
  • Scan websites you do not have the right to analyze where such activity is unlawful or prohibited.
  • Attempt to reverse engineer, exploit vulnerabilities in, or gain unauthorized access to the Service.

We may rate-limit, suspend, or block access to the Service to protect the Service, third parties, or our infrastructure.

7) Third-Party Services and Links

The Service may depend on or integrate with third-party services (such as Google APIs) and may include links to third-party websites. We do not control third-party services and are not responsible for their availability, changes, policies, or content.

8) Privacy and Data

The Service processes the URL you submit and technical metadata required to run the audit (e.g., strategy such as mobile/desktop, timing, and diagnostic logs).

This tool may operate without user accounts. However, we may temporarily store minimal logs for security, debugging, performance, and abuse prevention. Do not submit URLs containing sensitive personal data.

9) Intellectual Property

The Service, including its name, branding, design, and code (excluding third-party components), is owned by Hugo Maia - UX Designer and Web Developer. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

10) Limitation of Liability

To the maximum extent permitted by law, Hugo Maia - UX Designer and Web Developer will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business interruption, arising out of or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for any claim arising out of or related to the Service is limited to the amount you paid to use the Service in the 30 days preceding the event giving rise to the claim. If the Service is free, this amount is zero (0).

11) Indemnification

You agree to defend, indemnify, and hold harmless Hugo Maia - UX Designer and Web Developer from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12) Suspension and Termination

We may suspend or terminate access to the Service at any time, with or without notice, if we believe you have violated these Terms, if required by law, or to protect the Service or third parties.

13) Changes to the Service or Terms

We may modify, update, or discontinue the Service at any time. We may update these Terms by posting a revised version and updating the “Last updated” date above. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

14) Governing Law and Jurisdiction

These Terms are governed by the laws of Portugal/Matosinhos, without regard to conflict-of-law principles. Any disputes shall be brought exclusively in the courts of Matosinhos, unless mandatory consumer laws provide otherwise.
